The STB ruled  that Reserved Council under BMSMA Sect 53A does not apply to a condominium with a unit for shop use.   The principle should be based on the Grant of Written Permission from Urban Redevelopment Authority. Sect 53A applies to strata developments approved as Mixed Use  shown in the Written Permission. It was also reported that this case is now on appeal to the High Court on the point of law on the construction of Sect 53A.
